Supervisor Grant along with Council Members Gadd, Frounick, Mohun and George audited the Highway, General Fund and Special District claims, discussed Chatfield’s invoice and the water meter matter, also the Glen’s water issue. Supervisor Grant reported that the Town Highway Dept. will be getting the concrete beams from the Urf Road Bridge when the county does the repair work this Summer. Superintendent Jensen is working with Soil & Water and wants to use them on Schoellkopf Road where the creek is eroding.  

 

 

Bid Opening , 6:30PM – Surplus 12 x 16 garage door.  Three (3) bids received: Vince Meyer - $25;  Mike Forgnone - $300 and Patrick Feldman - $53.03

Supervisor Grant declared the meeting open and asked Councilman Frounick to lead the pledge to the flag.  Present were Council Members Gadd, Frounick, George and Mohun, also Assessor Wittmeyer.

 

Minutes of the March 11th meeting: Supervisor Grant asked if any corrections or amendments.  Councilman George, before the meeting, reported that under the Town Prosecutor Salary-The amount of the Prosecutor’s salary was adjusted to $3600 NOT $3500. County Member Mohun stated that under the Highway Dept., Supervisor Grant stated the millings would be available to the county not the town.  There being no further amendments or corrections, a motion was made by Mohun, seconded by Founick to accept the minutes as amended, voting all ayes, carried.

 

Supervisor Grant asked for Board approval on a support contract from Williamson Law Book for Payroll Software in the amount of $605. Motion made by George/Mohun to approve the Payroll Maintenance Software with Williamson Law Book in the amount of $605, voting all ayes, carried.

 

General Fund claims #88 -115  totaling $7697.98 presented.  Motion made by Frounick/George to approve the General Fund claims submitted. Voting all ayes, carried.

 

Highway claims #71 – 93 totaling $20,434.32 presented, which is the amended amount, deducting the $295.  Motion made by George, seconded by Gadd to approve the Highway claims presented, voting all ayes, carried.

 

Special District claims – Cowlesville Street Lighting claim #4 - $183 and Cowlesville Water District claims #16 – 21 totaling $2,490.55 presented.  Motion made by Mohun/Frounick to approve the Special District claims, voting all ayes, carried.

 

Supervisor’s Financial Statements for March 2009. Supervisor Grant also had the answer to Councilman George’s question from the February statement and so explained. Motion made by George/Mohun to approve the supervisor’s financial statements for February and March 2009. Voting all ayes, carried.

 

Correspondence: Monthly Report read from Richard Mazzarella, Chairman of the Town of  Bennington Wind Energy Advisory Committee.

   Letter dated Apr. 7th read from Kari Kelly re: Previous letter dated 11/9/07 sent to board re: Area Redi-Mix property being incorp. into the town’s zoning law.

   Certificate of insurance received from Hojnowski Transport naming the Town of         Bennington as additional insured.

   Town Clerk’s Monthly Report. 

Supervisor’s correspondence: Letter read from Attica Central School requesting the use of the town hall and a voting machine for $110 (voting machine custodial fee) on May 19th for their annual budget vote and also use of the town hall on May 5th for a town hall meeting on the budget.

   Read letter  dated Apr. 6th from Town Historian Michael Mohun requesting  his desire to join the Government Appointed Historians of Western New York also asked if the town would pay the annual dues of $20/year.

   Letter dated 2/19/09 from the Office of Community Renewal re: NYS CDBG Project #93PW196-04, Certification of Completion (Block Grant).

   Notice dated March 26th from the NYS DEC re: Hazardous Material Spill Notifications, Spill #0813930 (Reisdrof Brothers, Liquid Fertilizer).

   Letter from Tompkins Ins. Re: New York State Regulation 87, (purpose is to prevent Agents and Brokers from splitting insurance commissions with persons such as public officials and party members.)

   Letter dated 3/31/09 from the US Department of Agriculture re: Notification of Financing Available through USDA Rural Development for: Home Repair Loans and Grants for Very Low Income Households.

   Notice form Genesee/Finger Lakes Regional Planning Council of the Spring 2009 Regional Local Government Workshop scheduled for May 15th in Pittsford, NY.

   Notice of the 16th Annual Southern Tier West Local Government Conference scheduled for May 6th.

   Letter dated March 23rd from the Rochester Genesee Regional Transportation Authority

Re: Purchase Seven (7) small buses and two (2) bus stop shelters for Wyoming County.

 

Departments:

Highway -  Authorize the clerk to advertise for bids on road construction materials (bitumimus products, hauling, tiling) with the bid opening 6:30 PM at the May meeting.                   Motion made by George/Frounick to authorize the clerk to advertise for road construction materials with bid opening 6:30 PM at the May meeting. Voting all ayes, carried.

 

Bids for the surplus 12 x 16 overhead garage door. Three (3) bids received: Vince Meyer - $25;  Mike Forgnone - $300 and Patrick Feldman - $53.03.  Motion made by Frounick to award the bid to the highest bidder, that being $300 (Mike Forgnone) with the stipulation that he pays for it and picks up within 3 weeks. Motion seconded by Mohun, voting all ayes, carried.        

 

Zoning – New Home Occupation permit application received from Charlene Ruzewski, (Charlene’s Cheese Place) 2316 Clinton Street. Wants to use her garage as a walk in store to sell refrigerated cheese.  Motion made by Frounick/Gadd to approve her application, voting all ayes, carried.

 

Letter read from Art & Helen Thomas stating they will no longer need their home occupation permit for Counterpoint Holdings, he’s now working out of his office on the campus of Syracuse University.

Special Use Permit application received from Ronald Goudy, 560 Burrough, wants to put in a seasonal park mobile home on his property to be used by his parents when they come up for the Summer from Florida.  Motion made by  Frounick, seconded by  George to authorize the clerk to send to the Town Planning Board for their review and recommendations and  to advertise for a public hearing for the May Town Board Meeting. Voting all ayes, carried.

 

Scrap Metal Day – Motion made by Mohun to set Scrap Metal Day for May 9th..    Discussion held as to whether to put 2 notices in. After discussion Board Member Mohun included in her motion to  put 2 notices in the pennysaver,  the big ad in the pennysaver 2 weeks prior and a “reminder” notice  in the week prior. Motion seconded by Frounick, voting all ayes, carried.  Supervisor Grant stated that may be able to get on the Community Page also.

 

At this time, Supervisor Grant introduced Anthony Santoro, Wyo. Co, Emergency Services Coordinator who explained the new Road Numbering System to Board Members. He also talked about the NIMS 100 & 700 training, will advise Supervisor Grant when next training is scheduled, also can go on line to check the schedule at http://www.security.state.ny.us/training/training_calendar.php. Can also take the course on line.  Supervisor Grant thanked him for coming.

 

Public Concerns:   Mike Patanella from Highland Glens asked the status of the water for the Glens. Supervisor Grant reported the engineers have been doing preliminary drawings of the areas, check water pressure, talked about a lot of different options and it appears that the best way to proceed at this time is to run a line from Clinton Street to the Glens holding tank and operate off of the tank in the same manner as they do now, just doing bulk water purchasing. The engineer did drawings and figures for Dersam, Lapp Highland Glens and part of Getman and unless there is a tank built or pumping station, Dersam Road (maybe all of Dersam), part of Lapp and even part of Highland Glens, with the elevation would be a problem. Discussion held. Mr. Patanella stated that when the first came and talked to the board, talked about putting in a holding tank.  Supervisor Grant said they talked about that but now that Marilla and Alden are buying the remaining 7’ in Marilla’s holding tank, that will increase the pressure and fire flow, also when they loop the system, it will increase the pressure. Mr. Patanella talked about the Glens’ system being old and also the Glens residents are on the honor system regarding the use of the water, feels if they go this route, the honor system would be abused, that’s why they want to go with the individual meters. If they run a line from Clinton Street feel approx. 1500’ of line @$25-30 per foot is approx. $45,000.  Also might be able to get that done cheaper because they would not have to pay prevailing wage. Discussion held.  Mr. Patanella asked about available funding. Supervisor Grant reported she’s working on getting funding, was at a work shop on Friday, talked with a gentleman from the state on the Drinking Water Act., wasn’t encouraged by what he said, also talked with the man who helped with the financing of the Cowlesville Water District and explained the Glens situation. Supervisor Grant will keep him up to date.

 

Old business: Bathrooms at the park.  Councilman George asked if the board wants him to get a price on block, have plans drawn up. After discussion, Councilman Frounick would like to meet with people that use the park, get their ideas. Council Member Mohun wants to go to Strykersville to look at their building. Motion made by George to set up a meeting at the town park on April 22nd, 6:30 PM to discuss the bathrooms and to authorize the clerk to advertise. Motion seconded by Frounick, voting all ayes, carried.  Will invite Dan Sweetman, Mike Lapp, Chris Waldron, Terri Beal and any other coaches.

 

New business: Councilman George asked about the Commercial Junk Yard Law. Ms. Mohun reported that there is something in the state law, thinks it’s section 136.

 

Project Status Report from Jason Foote, Chatfield Engineers, where they recommended doing the 12” main, instead of 10” the town talked about for an addition $9000. Discussion held.  After discussion Councilman George stated he would like a second opinion.  Supervisor Grant reported she can give this information to Clark Patterson and ask them to have their report to the town by the 22nd. Councilman George asked if Erie Co, will give the town the 8” meter, or will they let the town use an 8” meter. Ellen stated Erie County will let the town use an 8” meter, but it’s more expensive, both to have and to buy, the meter pit is more and the meter cost is also more plus the amount for the monthly charge for the water (an increased minimum). Mr. George asked if knew how much more would have to use in comparison to what we use right now. Not sure but Ellen and Bernie thinks about a total of 2500/month more from what was said. Will further discuss on the 22nd.

 

Councilman Frounick stated that a person informed  him that he heard that Wind

Energy is dead in Bennington.  Mr. Frounick informed him that Bennington is working on a law, Town has NOT voted on anything regarding wind energy and maybe in a few months will have a law to vote on, informed him to watch the pennysaver.

 

Supervisor Grant reported that the Office of the Aging is accepting applications for the Senior Citizen of the Year.  She asked the board to let her know if there is someone they want to nominate, must be 60 years old and volunteers.

 

Supervisor Grant would like to put in the minutes that the old transfer station punch cards, the ones with the old rate have been destroyed, and they were audited by Councilman George and her. Once the existing box is used, will be going with the new ones at the higher $15 rate.

 

Approval for Attica Central School to use the town hall on May 19th for the budget vote and for the budget meeting on May 5th.  Motion made by Mohun/Frounick to allow Attica Central School to use the town hall on May 5th and 19th. Voting all ayes, carried.

 

Supervisor Grant has a One (1) week free scholarship to 4H Camp. If Board Members know of anyone (thinks between the ages of 8 & 15), to let her know.

 

Councilman George asked if Rick did anything with Woodley Road. Not sure. Short discussion held on roads.

 

There being no further business, a motion was made by Mohun/Gadd to adjourn.  Meeting adjourned at 9:25 PM.
