Supervisor Grant along with Council Members Mohun, Frounick, Gadd and George audited the Highway, General Fund and Special District claims and discussed town roads. Ellen reported on information on the NYS Retirement System (want to ACH the employee contributions from a town account) and the Goudy Special Permit.

Supervisor Grant declared the meeting open and asked Councilman Gadd to lead the pledge to the flag.  Present were Council Members George, Mohun, Gadd and Frounick.

 

Supervisor Grant opened the public hearing to consider a Local Law amending the Town of Bennington Zoning Law with regard to Zoning Map #2, adding item #1.10.

 

Minutes of the May meeting: Supervisor Grant asked if any corrections, amendments or additions.  Council Member Mohun stated that on page 211, where she made the comment about Mr. Goudy going through this process because the town has a moratorium on mobile homes and in order for him to get one, has to go through this process, so that he has permission to do that, trying to figure out if neighbors object.  The word object was omitted.  Councilman Frounick wanted it clarified that when discussing the mower and he said he will talk to “Gadd”, he meant  Alexander Equipment”.  There being no further corrections, amendments, a motion was made by George, seconded by Frounick to approve the minutes, voting all ayes, carried.

 

General Fund claims #160 – 191 totaling $17,323.00 presented.  Motion made by Mohun, seconded by Frounick to approve the general fund claims submitted, voting all ayes, carried.

 

Highway claims #117 – 129 totaling $29,660.18 presented. Asked if salt building repair should go against highway. Supervisor Grant reported that when the check came in from the insurance company for the repair, it was accidentally put into the Highway Fund, so rather than transfer it back out, just put the repair in against it. Councilman George asked if the insurance check covered the whole thing,  Ellen said the check was short due to the deductible. Motion made by Gadd, seconded by George to approve the highway claims, voting all ayes, carried.

 

 

Special District claims – Cowlesville Street Lighting claim #6 in the amount of $183 and Cowlesville Water district claims #27 – 31 totaling $1514.72 presented.  Motion made by George/Gadd to approve the Special District Claims. Voting all ayes, carried.

 

Correspondence: Bill for flowers for the town hall was $19.70, note written on bill that Carolyn Mruczek is donating them.

            Letter dated June 1st from Gov. Paterson’s office thanking town for letter of May 3rd in support of Collateral Source Legislation.

            E-mail received from Richard Mazzarella, Chairman of the Town of Bennington Wind Energy Advisor Committee requesting that an announcement be published in the Attica Pennysaver for two consecutive weeks. Clerk read his notice.           

            Received Assessor’s Wittmeyer's Disclosure Statement.

            Assessor Wittmeyer is ill tonight but has asked that residents be informed that she will be out taking pictures of homes for the Central Police System and also that she has registered her vehicle with the Sheriff’s Department.

            Certificates of insurance received from Tn. of Bennington naming James & Diane Fiske as additional insured and Certificates of Insurances received from Eugene Jaworski contracting  and Pavilion Drainage naming the Tn. of Bennington as additional insured.

            Supervisor Grant has received forms for the Property Maintenance Code of NYS – Violation Complaint Procedure.

            Notice from Genesee-Finger Lakes Planning Council the Regional Blueway (small boats) Analysis - Schedule of Stakeholder Meetings.

 

Wind Energy Advisory Committee’s ad – Discussion held as to why they want to continue to meet – do they want to add, keep updating their final report which has been accepted by the Town Board. Supervisor Grant feels they want to still meet because there is information that is still continuing and one of the things they mention was the community owned/operated wind farms. Councilman George questioned getting more information when they asked the board to accept their report in entirety, how they can add more to the already final report, if can’t take items out, how can they add to it. After a lengthily discussion, a motion was made by Gadd, seconded by George to re-advertise their meeting. After second thought, both Councilmen rescinded their motion and a motion was made by Gadd/George to table until it’s clarified as to what their intentions are. Voting all ayes.

 

Supervisor Grant has received an invitation to request 2 tickets to the Legman’s’  LPGA Golf Tournament in Rochester from Time Warner Cable, event runs from June 22nd – June 28th and asked if anyone is interested.

 

Departments:

Highway – Supervisor Grant will be sitting down with Highway Superintendent Jensen next week to do an analysis on town roads, what the cost are, what to focus on first. etc. Councilman George wanted to clarify that Ellen’s sister has volunteered her services and hopefully by next week, will have something. Supervisor Grant is hoping to have some data to look at, get an analysis on how much it will cost to do some of the key road projects, then decide what they want to focus on first, address the cost. Ellen reported that she and Rick are meeting on Wednesday morning. County Highway Superintendent Gadd looked over the town’s old report, found it very interesting and he’s willing to lend some expertise. Councilman George asked about a meeting in a couple of weeks to go over the information, try and decide what going to do. After short discussion a motion was made by George/Mohun to schedule a special meeting on June 23rd at 6:30 PM, to discuss highway matters. Voting all ayes, carried.

 

Woodley Road – Supervisor Grant reported that the town highway has been working on Woodley, have done grading work on most of the roads, working now on Dersam and focusing on  Woodley Road, stoning, ditching, drainage work and they also layed some big rocks into the deep ditches on Tooley Road.  

 

Zoning: Zoning Officer Kelly reported that town has two (2) Special Use permit applications that have not renewed, clerk sent letters, she has called, they still haven’t responded, this has been going on since last December.  After short discussion a motion was made by George to send them a last chance registered letter, giving them 20 days to renew, if they don’t renew and stay in business, the matter will be passed on to the town prosecutor and they will have to start the renewal process all over again, also when they do renew the cost of the registered letter to be added to the permit fee.  Motion seconded by Mohun, voting all ayes, carried.

 

As for the Lady on Bullis Road, Supervisor Grant has sent her the information she received from Council Member Mohun and info she has received from the sheriff.

 

Grievance Day: Reported went well only had 4 residents showed.

 

Councilman George reported he was up at the Wellness Center on Church Road, they have the 1st floor done, working on the 2nd floor.

 

Water: Supervisor Grant reported getting ready to mail the Water Quality Reports to all property owners in the district.  Councilman George asked about the letters to the delinquent residents who haven’t paid their water bills. Told those will be going out this week and explained the time frame in which things have to be done. Short discussion held on possibly updating the regulations in August.

 

Transfer station: Councilman Frounick asked about the cover for the hopper. After short discussion Board Members will take a look at it after the meeting if still light out.

 

Local Law to amend Zoning Law - Supervisor Grant read the amendment to Article 8, Section 1 of the zoning law amending Zoning Map 2 and adding 1.10  to that section and asked if any comments. The proposed law adds Area Redi-Mix to the list (which originally should have been on the list), zoning change was approved years ago, just not listed in the zoning book. No one was present at the Town Board Meeting except board members and the Zoning Officer. Supervisor Grant reported that the town cannot vote on it tonight, will have to go to the Town and County Planning Boards for their recommendations and approval. Motion made by Frounick/George to close the public hearing, voting all ayes, carried. Public hearing closed at 8:20 PM, voting all ayes, carried.    

 

Old Business: Wind Energy Advisory Committee – Supervisor Grant will check with them find out what their intentions are, find out how long they are going to meet and if have to re-advertise.

 

Veteran’s Monument Dedication – Supervisor Grant reported the dedication ceremony is scheduled for Sunday, June 14th (Flag Day) at 2 PM. On hand will be the Attica American Legion and the Boy Scouts who will also be having their annual Flag Day observance and flag burning ceremony at 12:30 PM at Sacred Heart Church. Other area veterans will also be present.

 

New business: Table Zoning Amendment pending reports from Planning Boards – Motion made by Mohun, seconded by George to table voting on the Local Law amending the zoning and to authorize the clerk to send the information to the Town and County Planning Boards for their consideration and recommendations. Voting all ayes, carried.

 

Constable Position – Supervisor Grant stated she received a call from Mike Hardie (Tompkins Insurance) regarding the town constable position (not all towns have constable positions, a lot of the towns have done away with them). The insurance underwriters have concluded that to have a Town Constable would add $1000/year to the premium. Haven’t used the constable since the last DWI trial, talked with the sheriff and can use a deputy if need be. Motion made by Frounick, seconded by Mohun to eliminate the Town Constable position effective July 1, 2009. Voting all ayes, carried.

 

Outstanding Senior Citizens 2009 – Supervisor Grant reported that Wyoming County Office for the Aging at their Senior Volunteer Service Recognition Awards Ceremony at the end of May, Merrill & Carol Weber were honored  for their senior volunteer service. They have spent many hours working at both the Wyoming Co. and Genesee County Office for the Aging, have done everything from taxes to mailings to the senior courier. Each week they pick-up day old bread and baked goods from Tops and take it to Community Action who gives it to seniors who are frail and can’t get to the store. They also provide dog therapy at the Erie Co. Nursing Home every two weeks and take care of Carol’s sister.

 

NYS Retirement System – They are going to on-line reporting and requesting permission to do an ACH transfer from one of the town accounts, most likely Trust & Agency, to pull the monthly retirement funds. This is the money taken out of employee’s paychecks for retirement benefits. Payroll monies are deposited from General fund and highway into Trust & Agency and cleared from there.  NYS Retirement will not have access to a lot of money.  Motion made by Frounick/George to approve NYS Retirement automatically pulling the retirement funds, Voting all ayes, carried.

 

Agreement with the Wyo. County Treasurer’s Office for Tax Collection software maintenance starting with 2009. Motion made by George, seconded by Gadd to authorize the supervisor to execute the agreement with the Wyo. County Treasurer’s office. Voting all ayes, carried.

 

Supervisor’s Financial Statement  - Supervisor Grant reported that the bookkeeper is unable to transfer the small interest amounts from the fire contracts, so we will have to voucher them to clear the accounts, will do  next month. Motion made by Mohun/Frounick to accept the Supervisor’s Financial statement. Voting all ayes, carried.

 

Councilman George feels town should thank Carolyn for donating the followers for in front of the town hall.

 

Councilman George asked about the emergency contractor list – should that be updated. Will dig out and have for the next meeting.

 

There being no further business, a motion was made by Mohun, seconded by Gadd to adjourn.  Meting adjourned at 8:36 PM.
